Participants agree that all prize winners are determined by Angel in its sole and absolute discretion and that no claim or dispute may be brought by any person or theatre participating in the ACN program. The Campaign is open to authorized theatre managers (or designated theatre representatives) of commercial movie theatres located in the United States that: Are registered participants in the Angel Cinema Network (ACN); Exhibited the campaign's film during the eligible engagement period; Reported grosses for said film to Comscore. Failure to report grosses to Comscore renders the theatre ineligible for any prize. Participants must be at least eighteen (18) years of age. Void where prohibited by law. Only one (1) prize may be awarded per theatre.
Winners will be the participants who accumulated the highest amount of points during the Promotion Period. If there is a tie between theatres in the amount of task points accumulated, bonus points will be allocated to said theatres based on expected gross (based on comp films that Angel determines) and the theatre's actual gross on the campaign's film. Each theatre may win a maximum of one (1) prize. Participants agree that all prize winners are determined by Sponsor in its sole and absolute discretion and that no claim or dispute may be brought by any person or theatre participating in the ACN program.
Prizes may include, but are not limited to, vacations, merchandise, goods, services, or experiential rewards. By accepting a prize, the recipient acknowledges and agrees that Angel Cinema Network and Angel Studios shall not be liable for any injury, loss, damage, or other harm of any kind arising from or related to the acceptance, use, or participation in any prize or prize-related activity. All prizes are accepted at the recipient's own risk and are subject to any additional terms and conditions imposed by the prize provider.
Each winner will receive an additional cash payment equal to thirty percent (30%) of the approximate retail value of the prize awarded. This payment is intended to assist with potential tax obligations. Winners are solely responsible for all federal, state, and local taxes. Sponsor may issue IRS Form 1099 as required by law.
Winners will be notified via email. Winners must claim their prize within seven (7) calendar days of notification. Failure to respond within seven (7) days will result in forfeiture of the prize, and an alternate winner may be selected.
Theatre managers awarded a prize may: Retain the prize personally; Transfer the prize to another employee of their theatre; Award the prize to a theatre guest or patron. Sponsor bears no responsibility for any transfer or secondary distribution made by the theatre manager.
Sponsor reserves the right to disqualify any participant found to be: Engaging in fraud; Manipulating reporting data; Falsifying marketing submissions; Attempting to unfairly influence Campaign outcomes. Any participant found engaging in fraud may be disqualified from this Campaign and from future Angel Cinema Network activities.
Sponsor reserves the right, in its sole discretion, to modify, suspend, or terminate the Campaign if technical failures, fraud, or any other factor impairs the integrity of the Campaign. Sponsor's decisions regarding all matters related to the Campaign are final and binding.
By accepting a prize, the winning theatre grants the Sponsor the right to use the theatre's name, city, and state, as well as the theatre manager's name and image, for advertising, promotional, and publicity purposes in any media now known or later developed, without additional compensation or notice, except where prohibited by law.
Sponsor is not responsible for: Lost, late, incomplete, or misdirected submissions; Errors in reporting or data transmission; Technical failures; Any injury, loss, or damage arising from participation or acceptance of a prize. Furthermore, to the fullest extent permitted by applicable law, Sponsor shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to loss of revenue, profits, or data, arising out of or in connection with these terms or participation in any related event. This limitation of liability applies regardless of the legal theory under which damages are sought, whether in contract, tort, or otherwise, and shall constitute the sole and exclusive remedy for any claims against Angel.
This Campaign shall be governed by the laws of the State of Utah, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the appropriate state or federal courts located in Utah.
